HOW TO SIGN-UP

  1. In order to enter the JBL Weekend Warrior Challenge (the “Competition”/ “promotion”/”event”) entrants must:
    • Visit the official JBL Weekend Warrior Challenge website at www.JBLWWC.com.au (the “Promotional Page”) and subscribe or update email and contact preferences.
    • Competition closes 9th August

    TERMS AND CONDITIONS

  2. These Terms and Conditions together with all other information provided prior form part of the rules of signing up. Instructions on how to sign up form part of these Terms and Conditions. Participation in signing up is deemed acceptance of these Terms and Conditions.
  3. Entry is only open to Australian residents.
  4. Entry is only open to persons aged eighteen (18) years of age. All persons attending the event will need to comply with the conditions of entry terms and condition, which include but is not limited to a safety waiver agreement upon entrance.
  5. Employees of the Promoter and its related companies (and their immediate families) and agencies associated with this event are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address, eligibility to enter and claim the prize, and any information submitted by the entrant in entering the promotion, before issuing the prize (including confirming consent of an entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian who gave their consent, where an entrant is under 18 years of age). If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entrant or entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction then all the entries of that entrant may be ineligible and deemed invalid.
  8. The Promoter reserves the right, at any time, to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
  9. Entries will be deemed invalid if they are considered by the Promoter to be:
    • Derogatory, disrespectful, abusive, racist, sexist or offensive;
    • Incomplete or indecipherable; or
    • Display or encourage illegal activity of any kind.
    By entering the promotion, each entrant grants to the Promoter a royalty-free, perpetual, worldwide, irrevocable, unconditional, non-exclusive, transferable licence (and agrees to use their best endeavours to procure any relevant third parties to grant to the Promoter such licence) to use their entry for the purposes of marketing and promoting the Promoter and/or its goods and services in any manner and in any media whether existing now or in the future, without the further consent of the entrant and without any further compensation payable to the entrant. Each entrant also expressly consents for the benefit of the Promoter to all or any acts or omissions that would ordinarily constitute an infringement of the entrant’s moral rights in relation to all Intellectual Property Rights in their entry pursuant to the Copyright Act 1968 (Cth), including the Promoter having an unfettered right to treat the entry in any manner at its sole discretion, to alter the entry in any manner and to the Promoter not attributing authorship of the winning entry to the entrant.
  10. Once an entry is submitted, entrants acknowledge that entrance is not guaranteed and the entry may not be withdrawn, altered or deleted (except as and where required by the Promoter).
  11. The Competition Period commences and closes on the below dates / times (“Competition Period”):
    • Opens: Monday, 30 July 2018 at 9:00am (AEST).
    • Closes: Thursday, 9 August 2018 at 11:59pm (AEST).
  12. (“Winners”). Winners will be selected at random and if successful contacted about their entry and the event details on Friday 10 August for confirmation of their involvement.
  13. At the conclusion of the Competition Period, successful entrants will be selected as the winner (the “Winners”) of the Competition by a panel appointed by the Promoter. Each entry will be judged on uniqueness and creative merit. Chance plays no part in the determination of the successful entries.
  14. The Winners shall be determined at the offices of the Promoter on Friday 10 August 2018 at 12:00pm (AEST). The Winners will be notified by email. The panel’s decision is final and binding upon all entrants and no correspondence will be entered into.
  15. The Winners shall be entitled to receive the following prize, being the ‘JBL Weekend Warrior Challenge’ prize (the “prize”):
    • Participation at the JBL Weekend Warrior Challenge, held on Sunday 19th August, 12-6pm at Bondi, Sydney NSW. Full event details can be found on the official JBL Weekend Warrior Challenge website at www.JBLWWC.com.au
  16. The prize will only be awarded following any Winner validation and verification that the Promoter, or its nominated agents, requires in their sole absolute discretion.
  17. It is a condition of accepting and participating in the prize that the Winner may be required to sign eligibility form(s), code(s) of conduct and/or legal release(s) (including prize acceptance release(s)) in a form determined by the Promoter in its absolute discretion. If the Winner is under 18 years of age, their parent or legal guardian must also agree to and sign such documents (if requested by the Promoter).
  18. Each Winner is responsible for all other costs associated with redeeming the prize, including without limitation, accommodation, travel, meals and other miscellaneous expenses. The Winner is to provide their own insurance (if required).
  19. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a gift to the equal value and/or specification.
  20. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash.
  21. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
  22. Any attempt to cause malicious damage or interference with the normal functioning of the Promotional Page, or the information on the Promotional Page, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
  23. Any cost associated with accessing the Competition is the sole responsibility of the entrant, and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition or the prize, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of a prize, including use resulting in any personal injury.
  25. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
  26. An entrant also agrees that the Promoter may, in the event the entrant is the Winner, publish or cause to be published the entrant Winner’s name and locality in any media, including on the Promotional Page.
  27. All Personal Information will be stored by the Promoter in accordance with the Promoter’s privacy policy. A copy of the Promoter’s privacy policy in relation to the treatment of personal information collected may be obtained by contacting the Privacy Officer.
